These Terms of Service are a binding agreement between you and Currnt LLC, a North Carolina limited liability company ("Currnt," "we," "us"). By accessing or using the Currnt platform, websites, booking tools, or related services (together, "the Service"), you agree to these terms. If you are using the Service on behalf of a business, you represent that you have authority to bind that business. If you do not agree to these terms, do not use the Service.
Currnt provides marketing and booking software for charter operators ("Captains"), including website creation and hosting, a booking and lead management system, a captain portal with analytics, search engine optimization services, performance reporting, and, on eligible plans, managed advertising services. The specific features and service levels included depend on the subscription plan you select. We may add, change, or remove features of the Service over time.
Currnt is a software and marketing provider only. We do not own, operate, inspect, or supervise any vessel or charter business, and we are not a party to any charter, trip, or transaction between a Captain and their customers ("Guests"). Every booking made through the Service is an agreement solely between the Captain and the Guest. Captains are solely responsible for their charter operations, including vessel safety and maintenance, crew, licensing (including U.S. Coast Guard and state requirements), permits, insurance, compliance with all applicable laws, trip quality, pricing, cancellations, and any refunds owed to Guests. Currnt has no responsibility or liability for any injury, loss, or damage arising from a charter trip or a Captain’s business operations.
You are responsible for maintaining the security of your account, including the email address used to receive login links, and for all activity that occurs under your account. You agree to provide accurate and current information and to notify us immediately at support@currntapp.com of any unauthorized use of your account.
Subscription fees are billed monthly in advance through our payment processor, Stripe. A one-time setup fee is charged at the start of service. All fees are non-refundable except where required by law. If a payment fails, we may suspend or limit the Service until payment is made. We may change our prices with at least 30 days’ advance notice; price changes take effect at your next billing cycle after the notice period. You are responsible for any applicable taxes.
You may cancel your subscription at any time by emailing support@currntapp.com. Cancellation takes effect at the end of your current billing period, and you will not be charged again after that. Amounts already paid, including setup fees, are not refunded. We may terminate or suspend your access at any time for breach of these terms, non-payment, or unlawful use, and otherwise on 30 days’ notice.
You retain ownership of the content you provide to us, including business information, photos, logos, and text ("Your Content"). You grant Currnt a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, and adapt Your Content as needed to build and operate your website and provide the Service. You represent that you own or have the necessary rights to Your Content and that it does not infringe anyone else’s rights, including copyright and image rights. We may remove content that we reasonably believe is unlawful or infringing.
The Service sends emails to your Guests on your behalf, such as booking confirmations, reminders, and follow-ups. You represent that you have the right to contact the customers whose information you provide or collect through the Service, and that your use of these communications complies with applicable law, including the CAN-SPAM Act.
You agree not to use the Service for any unlawful, deceptive, or fraudulent purpose; to misrepresent your business, licensing, or qualifications; to transmit malware or harmful content; to attempt to gain unauthorized access to the Service or its systems; or to interfere with the operation of the Service or its use by others.
Currnt retains all rights, title, and interest in the Service, including the platform, software, templates, and designs. Except for Your Content, nothing in these terms transfers any Currnt intellectual property to you. Data about your business generated through the Service, such as bookings, leads, and customer records, is yours, and you may request an export of it at any time.
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or secure. Marketing outcomes depend on many factors outside our control; we do not guarantee any particular search ranking, ad performance, number of leads or bookings, or level of revenue.
To the maximum extent permitted by law, Currnt will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, arising from or related to the Service. To the maximum extent permitted by law, Currnt’s total liability for all claims arising out of or relating to the Service will not exceed the amounts you paid to Currnt in the 12 months before the event giving rise to the claim.
You agree to defend, indemnify, and hold harmless Currnt LLC and its members, officers, and agents from and against any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising from your charter operations, any trip or interaction with a Guest, Your Content, your violation of these terms, or your violation of any law or the rights of a third party.
Upon termination of your subscription for any reason, your access to the Service will end and your website will be taken down. You may request an export of your business data within 30 days after termination. After 30 days, we may delete your data, except where we are legally required to retain it.
These terms are governed by the laws of the State of North Carolina, without regard to its conflict of laws rules. Any dispute arising out of or relating to these terms or the Service will be brought exclusively in the state or federal courts located in North Carolina, and you consent to their jurisdiction.
We may update these terms from time to time. If we make material changes, we will notify you by email or through the Service before they take effect. Your continued use of the Service after changes take effect constitutes acceptance of the updated terms.
